  • In regards to new energy production and alternative energy in New York, Senator LaValle voted against S.5908 to reauthorize Article X of Public Service Law governing siting of major electric generating facilities, a bill that does not do enough to include public in decision-making or protect public health and environment.
  • He supports expanding eligibility criteria in existing state law to include non-residential solar and wind energy systems, and increase limits on residential solar, wind and farm waste systems S.8481 and S.8145 which creates a real property tax abatement for solar power system in New York City
  • He is in favor of establishing tax credits to assist in offsetting the initial costs of constructing and installing solar and wind energy systems and fuel cell electric generating equipment, S.1634 and S.1634-b
  • He voted for making taxpayers who install solar energy systems eligible for tax credits and increases size of eligible solar energy systems from 10 to 50 kilowatts S.4482
  • Dealing with petroleum taxes in 2007 LaValle initially voted against S.5011, which extends petroleum business tax exemptions on heating oil sold to businesses, thereby incentivizing consumption of such fuels and further degradation of NYS' air quality. In 2008, he supported the same legislation, S.7594-b.
  • LaValle supports energy efficient legislation S.5451, which extends the allowance of tax credits for purchase of energy efficient home heating systems (up to $500 until 2009) and for purchase of cleaner heating fuel oil (extends bio-heat tax credit until 2011).
  • Senator LaValle chose not to sponsor S.5347 and S.5371, which earmarked revenue from the sale of CO2 emissions allowances under for energy efficiency and clean energy and created a dedicated clean energy fund.
